Data Processing Notice

When a counseling contract is concluded or possibly in preparation for it, I collect the following information:
- Salutation, first name, last name
- Email address
- Address
- Telephone number / mobile number
- all information that you entrust to me within the framework of counseling and that may be documented in the counseling file if necessary.
The collection of this data is carried out,
- to be able to identify you as a client
- to be able to advise you appropriately
- for billing purposes
- if necessary, for the settlement of any liability claims and for the assertion of any claims against you
Data processing is carried out in accordance with our contractual agreement for the purpose of counseling you and is necessary for the fulfillment of mutual obligations.
The personal data collected by me for counseling is initially stored for the purpose of contract fulfillment and subsequently until the expiration of civil law limitation periods for the purpose of accountability, defense against liability claims and the protection of legitimate interests. It will then be deleted, unless I am obligated to longer storage due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to storage beyond that according to Art. 6 Para. 1 S. 1 lit. a GDPR.
A transfer of your data to third parties generally only takes place to the extent that this is necessary for contract fulfillment and when it also concerns professional secrets only to the extent that you have released me from my professional confidentiality obligation or this is exceptionally necessary for the assertion of legitimate interests or for the fulfillment of legal obligations.
Data Subject Rights:
You have the right:
- insofar as data processing is based on the legal basis of consent, according to Art. 7 Para. 3 GDPR to revoke your once given consent to me at any time. This has the consequence that I may not continue the data processing that was based on this consent for the future;
- according to Art. 15 GDPR to request information about your personal data processed by me. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data was or will be disclosed, the planned storage duration, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to complain, the origin of your data, insofar as it was not collected from us, as well as about the existence of automated decision-making including profiling and possibly meaningful information about their details;
- according to Art. 16 GDPR to immediately request the correction of incorrect or completion of your personal data stored with me;
- according to Art. 17 GDPR to request the deletion of your personal data stored with me, insofar as processing is not necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
- according to Art. 18 GDPR to request the restriction of processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful but you refuse its deletion and I no longer need the data, but you need it for asserting, exercising or defending legal claims or you have filed an objection against processing according to Art. 21 GDPR;
- according to Art. 20 GDPR to receive your personal data that you have provided to me in a structured, common and machine-readable format or to request transmission to another controller and
- according to Art. 77 GDPR to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or my practice location for this purpose.
Right to Object
Insofar as your personal data is processed on the basis of legitimate interests according to Art. 6 Para. 1 S. 1 lit. f GDPR, you have the right according to Art. 21 GDPR to object to the processing of your personal data, insofar as there are reasons for this that arise from your particular situation.
