Relevant legal bases

Relevant legal bases under the GDPR: Below you will find an overview of the GDPR legal bases on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, national data protection rules in your or our country of residence or establishment may apply. Should more specific legal bases be relevant in individual cases, we will inform you of these in this privacy policy.

  • Consent (Art. 6(1) sentence 1 lit. (a) GDPR) – The data subject has given consent to the processing of their personal data for one or more specific purposes.
  • Performance of a contract and pre-contractual enquiries (Art. 6(1) sentence 1 lit. (b) GDPR) – Processing is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract.
  • Legal obligation (Art. 6(1) sentence 1 lit. (c) GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

National data protection provisions: In addition to the data protection provisions of the GDPR, national data protection rules may apply in your or our country of residence or establishment. In particular, this includes the German Federal Data Protection Act (BDSG), where applicable. The BDSG contains specific provisions on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission, as well as automated decision-making in individual cases, including profiling. State data protection laws of individual German federal states may also apply where relevant.

Security measures

In accordance with statutory requirements, we take appropriate technical and organisational measures, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, in order to ensure a level of protection appropriate to the risk.

Such measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data, as well as access, input, transfer, availability and segregation. Furthermore, we have established procedures to ensure the exercise of data subject rights, the deletion of data, and responses to risks to the data. We also take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default.

TLS encryption (https): To protect the data you transmit via our online offering, we use TLS encryption. You can recognise such encrypted connections by the prefix https:// in the address bar of your browser.

Transmission of personal data

In the course of our processing of personal data, it may occur that data is transmitted to, or disclosed to, other entities, companies, legally independent organisational units or persons. Recipients of this data may include, for example, service providers tasked with IT functions, or providers of services and content that are integrated into a website. In such cases we observe statutory requirements and, in particular, conclude appropriate contracts or agreements with the recipients of your data that serve to protect your data.

International data transfers

Data processing in third countries: Insofar as we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or processing takes place in the context of using third-party services or the disclosure or transmission of data to other persons, entities or companies, this will only take place in accordance with statutory requirements. Where the level of data protection in the third country has been recognised by means of an adequacy decision (Art. 45 GDPR), this serves as the basis for the data transfer. Otherwise, data transfers will only take place if the level of data protection is otherwise secured, in particular by standard contractual clauses (Art. 46(2) lit. (c) GDPR), explicit consent, or in the case of contractual or legally required transmission (Art. 49(1) GDPR). We will inform you of the basis for transfer to third countries with respect to the individual providers in question, with adequacy decisions taking precedence as a basis. Information on third-country transfers and existing adequacy decisions can be found on the website of the European Commission: https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data-protection_en.

EU–US Trans-Atlantic Data Privacy Framework: Under the so-called "Data Privacy Framework" (DPF), the European Commission has, by adequacy decision of 10 July 2023, recognised the level of data protection as adequate also for certain companies in the United States. The list of certified companies, as well as further information on the DPF, can be found on the website of the U.S. Department of Commerce at https://www.dataprivacyframework.gov/. As part of our privacy notices, we inform you which of the service providers we use are certified under the Data Privacy Framework.

Deletion of data

The data processed by us is deleted in accordance with statutory requirements as soon as the consents permitting its processing are revoked or other permissions cease to apply (e.g. when the purpose of the processing no longer applies or the data is no longer necessary for the purpose). Insofar as data is not deleted because it is necessary for other and legally permissible purposes, its processing will be limited to those purposes. That is to say, the data is restricted and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax-law reasons, or whose storage is necessary for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person. As part of our privacy notices we may provide users with further information on the deletion and retention of data that specifically applies to the respective processing activities.

Rights of data subjects

Rights of data subjects under the GDPR: As a data subject, you are entitled under the GDPR to various rights, which arise in particular from Articles 15 to 21 GDPR:

  • Right to object: You have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data which is based on Art. 6(1) lit. (e) or (f) GDPR; this also applies to profiling based on those provisions. Where personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for the purposes of such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
  • Right to withdraw consent: You have the right to withdraw any consent you have given at any time.
  • Right of access: You have the right to obtain confirmation as to whether or not your personal data is being processed, and to receive information about such data, as well as further information and a copy of the data, in accordance with statutory requirements.
  • Right to rectification: You have the right, in accordance with statutory requirements, to request the completion of data concerning you, or the rectification of inaccurate data concerning you.
  • Right to erasure and to restriction of processing: You have the right, in accordance with statutory requirements, to request that data concerning you be erased without delay, or alternatively, in accordance with statutory requirements, to request a restriction of the processing of the data.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us in a structured, commonly used and machine-readable format, or to request its transmission to another controller, in accordance with statutory requirements.
  • Right to lodge a complaint with a supervisory authority: In accordance with statutory requirements and without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular a supervisory authority in the Member State of your habitual residence, the supervisory authority of your workplace, or the place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the GDPR.

Use of cookies

Cookies are small text files, or other forms of storage notation, which store information on terminal devices and read information from those terminal devices. For example, they may store login status in a user account, the contents of a shopping basket in an e-shop, the content accessed, or the functions used within an online offering. Cookies can also be used for various purposes — for example for the functionality, security and comfort of online offerings, and for analysing visitor flows.

Notes on consent: We use cookies in accordance with statutory requirements. We therefore obtain prior consent from users, unless this is not legally required. Consent is not necessary, in particular, where the storage and reading of information — including from cookies — is strictly necessary in order to provide users with an expressly requested telemedia service (i.e. our online offering). Strictly necessary cookies are generally those whose functions serve the display and functioning of the online offering, load balancing, security, the storage of users' preferences and choices, or similar purposes related to the provision of the main and ancillary functions of the online offering requested by the user. Revocable consent is clearly communicated to users and contains information on the relevant cookie usage.

Notes on the legal basis under data-protection law: The data-protection legal basis on which we process the personal data of users with the aid of cookies depends on whether we ask users for consent. If users do consent, the legal basis for processing their data is the consent declared. Otherwise, the data processed with the aid of cookies is processed on the basis of our legitimate interests (e.g. in the commercial operation of our online offering and the improvement of its usability), or, where this takes place in the course of fulfilling our contractual obligations, where the use of cookies is necessary to fulfil our contractual obligations. We provide information on the purposes for which we process cookies in the course of this privacy policy, or in the context of our consent and processing procedures.

Storage duration: The following types of cookies are distinguished in terms of storage duration:

  • Temporary cookies (also: session cookies): Temporary cookies are deleted at the latest after a user has left an online offering and closed their terminal device (e.g. browser or mobile application).
  • Permanent cookies: Permanent cookies remain stored even after the terminal device is closed. For example, login status can be stored, or preferred content can be displayed directly when a user revisits a website. Similarly, the data collected with the aid of cookies can be used for reach measurement. Unless we provide users with explicit information about the type and storage duration of cookies (e.g. when obtaining consent), users should assume that cookies are permanent and that the storage duration may be up to two years.

General information on revocation and objection (so-called "opt-out"): Users may at any time withdraw the consents they have given and object to processing in accordance with statutory requirements. To do so, users can, among other things, restrict the use of cookies in their browser settings (note that this may also restrict the functionality of our online offering). An objection to the use of cookies for online marketing purposes can also be declared via the websites https://optout.aboutads.info and https://www.youronlinechoices.com/.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: provision of our online offering and user-friendliness.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); consent (Art. 6(1) sentence 1 lit. (a) GDPR).

Further notes on processing operations, procedures and services:

  • Processing of cookie data on the basis of consent: We use a cookie consent-management procedure, in the context of which users' consent to the use of cookies — or to the processing operations and providers named within the cookie consent-management procedure — is obtained, and can be managed and withdrawn by users. The consent statement is stored so that the query does not have to be repeated, and so that the consent can be evidenced in accordance with statutory requirements. Storage may take place server-side and/or in a cookie (so-called opt-in cookie, or by means of comparable technologies) in order to be able to assign the consent to a user or their device. Subject to individual information about cookie management service providers, the following applies: the consent may be stored for up to two years. A pseudonymous user identifier is generated and stored together with the time of consent, details of the scope of consent (e.g. which categories of cookies and/or service providers) and the browser, system and end device used; Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR).
  • Cookie opt-out: In the footer of our website you will find a link via which you can change your cookie settings and revoke the relevant consents; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Business services

We process data of our contractual and business partners — for example customers and prospects (collectively referred to as "contractual partners") — in the context of contractual and comparable legal relationships, as well as associated measures, and in the course of communication with the contractual partners (or prior to a contract), for example to respond to enquiries.

We process this data in order to fulfil our contractual obligations. This includes, in particular, the obligation to provide the agreed services, any update obligations, and remedies in the case of warranty claims and other performance issues. We also process the data to safeguard our rights and for the purposes of the administrative tasks associated with these obligations, as well as for the organisation of our business. Furthermore, we process the data on the basis of our legitimate interests in the proper and commercially sound conduct of our business, and in security measures to protect our contractual partners and our business operations from misuse and from threats to their data, secrets, information and rights (e.g. for involving telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisers, payment service providers or tax authorities). Within the framework of applicable law, we only pass on the data of contractual partners to third parties to the extent that this is necessary for the aforementioned purposes or to comply with legal obligations. Contractual partners are informed about further forms of processing — for example for marketing purposes — within the framework of this privacy policy.

We inform contractual partners of which data is required for the aforementioned purposes before or in the course of data collection, e.g. in online forms, by special marking (e.g. colours) or symbols (e.g. asterisks or similar), or in person.

We delete the data after expiry of statutory warranty obligations and comparable obligations — that is, generally after 4 years — unless the data is stored in a customer account, e.g. as long as it must be retained for legal archiving reasons. The statutory retention period is ten years for documents relevant under tax law, as well as for commercial books, inventories, opening balance sheets, annual financial statements, the working instructions necessary for understanding these documents, and other organisational documents and accounting records; for received commercial and business letters and copies of dispatched commercial and business letters, the period is six years. The period begins at the end of the calendar year in which the last entry was made in the book, the inventory, opening balance sheet, annual financial statement or management report was prepared, the commercial or business letter was received or dispatched, or the accounting record was created, or in which the relevant entry was made or the other documents arose.

Insofar as we use third-party providers or platforms to render our services, the terms and conditions and privacy notices of the respective third-party providers or platforms shall apply in the relationship between users and such providers.

  • Types of data processed: inventory data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contact data (e.g. email, telephone numbers); contract data (e.g. subject of the contract, term, customer category).
  • Data subjects: prospects; business and contractual partners.
  • Purposes of processing: provision of contractual services and fulfilment of contractual obligations; contact requests and communication; office and organisational procedures; management and response to enquiries.
  • Legal bases: performance of a contract and pre-contractual enquiries (Art. 6(1) sentence 1 lit. (b) GDPR); legal obligation (Art. 6(1) sentence 1 lit. (c) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

  • Appointment scheduling & payment for appointments: We process our customers' data in order to enable them to select, acquire or order the services chosen, as well as to pay for and have them delivered or carried out. Where necessary for the execution of an order, we use service providers — in particular postal, freight and shipping companies — in order to deliver or carry out the service for our customers. For the processing of payment transactions, we use the services of banks and payment service providers. The data required is marked as such in the course of the order or comparable acquisition process and includes the information required for delivery, provision and billing, as well as contact information in order to enable us to consult with you if needed. Legal bases: performance of a contract and pre-contractual enquiries (Art. 6(1) sentence 1 lit. (b) GDPR).
  • Psychological counselling: We process the data of our clients as well as prospects and other principals or contractual partners (collectively referred to as "clients") in order to provide our services to them. The data processed, the nature, scope, purpose and necessity of its processing are determined by the underlying contractual and client relationship.

In the course of our work we may also process special categories of data, in particular information on the health of clients, where applicable in relation to their sexual life or sexual orientation, as well as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade-union membership. Where necessary, we obtain the explicit consent of the clients to this, and otherwise process special categories of data where this serves the health of the clients, where the data is public, or where other statutory permissions apply.

Where it is necessary for the performance of our contract, for the protection of vital interests, or required by law, or where consent of the clients exists, we disclose or transmit the data of clients — observing professional-law requirements — to third parties or commissioned parties, such as authorities, billing offices, and in the field of IT, office or comparable services; Legal bases: performance of a contract and pre-contractual enquiries (Art. 6(1) sentence 1 lit. (b) GDPR).

Payment procedures

Within the context of contractual and other legal relationships, due to legal obligations or otherwise on the basis of our legitimate interests, we offer the persons concerned efficient and secure payment options, and use — in addition to banks and credit institutions — further service providers for this purpose (collectively "payment service providers").

The data processed by the payment service providers includes inventory data such as name and address; bank data such as account numbers or credit card numbers; passwords, TANs and check digits; as well as contract-, total- and recipient-related details. This information is required in order to carry out the transactions. The data entered, however, is only processed by, and stored with, the payment service providers. That is, we do not receive any account- or credit-card-related information, but only information with confirmation or notification of payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit reference agencies. The purpose of this transmission is identity and creditworthiness checks. In this regard we refer to the terms and the privacy notices of the payment service providers.

The terms and conditions and privacy notices of the respective payment service providers, which can be accessed within their websites or transaction applications, apply to the payment transactions. We also refer to these for further information and for the exercise of rights of withdrawal, access and other rights of data subjects.

  • Types of data processed: inventory data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contract data (e.g. subject of the contract, term, customer category); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status); contact data (e.g. email, telephone numbers).
  • Data subjects: customers; prospects.
  • Purposes of processing: provision of contractual services and fulfilment of contractual obligations.
  • Legal bases: performance of a contract and pre-contractual enquiries (Art. 6(1) sentence 1 lit. (b) GDPR).

Further notes on processing operations, procedures and services:

Provision of the online offering and web hosting

We process users' data in order to be able to make our online services available to them. For this purpose we process the user's IP address, which is necessary in order to transmit the content and functions of our online services to the user's browser or terminal device.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: provision of our online offering and user-friendliness; information-technology infrastructure (operation and provision of information systems and technical devices (computers, servers etc.)); security measures.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

  • Provision of online offering on rented storage space: For the provision of our online offering, we use storage space, computing capacity and software, which we rent from a corresponding server provider (also referred to as a "web host") or obtain in some other way; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • Collection of access data and log files: Access to our online offering is logged in the form of so-called "server log files". The server log files may include the address and name of the websites and files accessed, date and time of access, transmitted data volumes, notification of successful retrieval, browser type and version, the user's operating system, referrer URL (the previously visited page), and in general IP addresses and the requesting provider. The server log files may be used, on the one hand, for security purposes, e.g. to avoid overloading the servers (in particular in the case of abusive attacks, so-called DDoS attacks), and on the other hand, to ensure the utilisation of the servers and their stability; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR). Deletion of data: log-file information is stored for a maximum period of 6 weeks and then deleted or anonymised. Data whose further retention is required for evidentiary purposes is exempt from deletion until the respective incident is finally clarified.
  • STRATO: services in the field of provision of information-technology infrastructure and related services (e.g. storage space and/or computing capacity); Service provider: STRATO AG, Pascalstraße 10, 10587 Berlin, Germany; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Website: https://www.strato.de; Privacy policy: https://www.strato.de/datenschutz. Data-processing agreement: provided by the service provider.

Blogs and publication media

We use blogs or comparable means of online communication and publication (hereinafter "publication medium"). Readers' data is processed for the purposes of the publication medium only insofar as this is necessary for its presentation and for communication between authors and readers, or for security reasons. Beyond that, we refer to the information on the processing of visitors to our publication medium within the scope of this privacy policy.

  • Types of data processed: inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: provision of contractual services and fulfilment of contractual obligations; feedback (e.g. collecting feedback via online form); provision of our online offering and user-friendliness.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

  • Comments and contributions: If users leave comments or other contributions, their IP addresses may be stored on the basis of our legitimate interests. This serves our protection in the event that someone leaves unlawful content (insults, prohibited political propaganda etc.) in comments and contributions. In such cases, we ourselves may be held responsible for the comment or contribution and therefore have an interest in the identity of the author.

Furthermore, we reserve the right, on the basis of our legitimate interests, to process users' information for the purpose of spam detection.

On the same legal basis we reserve the right, in the case of surveys, to store users' IP addresses for the duration of the survey, and to use cookies to prevent multiple voting.

Personal information, any contact and website information, as well as content provided in comments and contributions, are stored by us permanently until the user objects; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • Medium: hosting platform for blogs / websites; Service provider: A Medium Corporation, P.O. Box 602, San Francisco, CA 94104–0602, USA; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Website: https://medium.com/. Communication via messenger

We use messengers for communication purposes and ask you to observe the following notes on the functioning of the messengers, on encryption, on the use of communication metadata, and on your possibilities for objection.

You can also contact us by other means, such as by telephone or email. Please use the contact options communicated to you or the contact options provided within our online offering.

In the case of end-to-end encryption of content (i.e. the content of your message and attachments), we point out that the content of communications (i.e. the content of the message and attached images) is end-to-end encrypted. This means that the content of the messages is not visible, not even by the messenger providers themselves. You should always use an up-to-date version of the messenger with encryption activated so that the encryption of message contents is ensured.

However, we additionally point out to our communication partners that the messenger providers, while not being able to view the content, can ascertain that and when communication partners are communicating with us, as well as technical information about the communication partners' device used and, depending on their device settings, location information (so-called metadata) is processed.

Notes on legal bases: Insofar as we ask communication partners for permission before communicating with them via messenger, the legal basis for our processing of their data is their consent. Otherwise — if we do not ask for consent and they contact us on their own initiative — we use messengers in the relationship with our contractual partners and in the context of contract initiation as a contractual measure, and in the case of other prospects and communication partners on the basis of our legitimate interests in fast and efficient communication and the needs of our communication partners for messenger communication. Furthermore, we point out that we will not transmit contact data communicated to us to messengers for the first time without your consent.

Withdrawal, objection and deletion: You can withdraw any consent given at any time and object to communication with us via messenger at any time. In the case of communication via messenger, we delete messages in accordance with our general deletion guidelines (i.e. e.g., as described above, after the end of contractual relationships, in the context of archiving requirements, etc.) and otherwise as soon as we can assume that we have answered any enquiries from communication partners, where no further reference to a previous conversation is to be expected, and where no statutory retention obligations stand in the way of deletion.

Reservation of reference to other communication channels: Finally, we would like to point out that for your security we reserve the right not to answer enquiries via messenger. This applies, for example, where contractual matters require special confidentiality or where an answer via messenger does not meet formal requirements. In such cases we will refer you to more appropriate communication channels.

  • Types of data processed: contact data (e.g. email, telephone numbers); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: communication partners.
  • Purposes of processing: contact requests and communication; direct marketing (e.g. by email or post).
  • Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

Video conferences, online meetings, webinars and screen sharing

We use platforms and applications of other providers (hereinafter referred to as "conference platforms") for the purposes of conducting video and audio conferences, webinars and other types of video and audio meetings (collectively referred to as "conference"). When selecting conference platforms and their services, we observe the statutory requirements.

Data processed by conference platforms: Within the scope of participation in a conference, the conference platforms process the personal data of participants referred to below. The scope of processing depends on the one hand on which data is required in the course of a specific conference (e.g. provision of access data or real names) and on which optional information is provided by participants. In addition to processing for the conduct of the conference, the data of participants may also be processed by the conference platforms for security purposes or service optimisation. Processed data includes personal data (first name, last name), contact information (email address, telephone number), access data (access codes or passwords), profile pictures, information on professional position/function, the IP address of the internet connection, information on participants' end devices, their operating system, browser and its technical and language settings, information on the content of communication processes, i.e. entries in chats as well as audio and video data, and the use of other available functions (e.g. polls). The content of communications is encrypted to the extent technically provided by the conference providers. If participants are registered with the conference platforms as users, additional data may be processed in accordance with the agreement with the respective conference provider.

Logging and recordings: If text entries, participant results (e.g. from polls) or video or audio recordings are logged, this is transparently communicated to participants in advance and, where necessary, their consent is requested.

Data protection measures by participants: For details on the processing of your data by the conference platforms, please refer to their privacy notices and choose the security and data protection settings that are optimal for you within the conference platforms' settings. Please also ensure for the duration of a video conference that the background of your recording protects the data and privacy of others (e.g. by informing housemates, locking doors, and, where technically possible, using a function to obscure the background). Links to conference rooms as well as access data must not be passed on to unauthorised third parties.

Notes on legal bases: Insofar as, in addition to the conference platforms, we also process users' data and ask users for their consent to the use of the conference platforms or specific functions (e.g. consent to a recording of conferences), the legal basis for processing is that consent. Furthermore, our processing may be necessary for the fulfilment of our contractual obligations (e.g. in participant lists, in the case of preparing the results of conversations, etc.). Otherwise, users' data is processed on the basis of our legitimate interests in efficient and secure communication with our communication partners.

  • Types of data processed: inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: communication partners; users (e.g. website visitors, users of online services); persons depicted.
  • Purposes of processing: provision of contractual services and fulfilment of contractual obligations; contact requests and communication; office and organisational procedures.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

Audio content

We use hosting and analysis services from service providers in order to offer our audio content for listening or download and to obtain statistical information on the retrieval of the audio content.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: reach measurement (e.g. access statistics, recognition of returning visitors); conversion measurement (measurement of the effectiveness of marketing measures); profiles with user-related information (creation of user profiles); provision of our online offering and user-friendliness.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

Cloud services

We use software services accessible via the internet and executed on the servers of their providers (so-called "cloud services", also referred to as "Software as a Service") for the storage and management of content (e.g. document storage and management, exchange of documents, content and information with specific recipients, or publication of content and information).

In this context, personal data may be processed and stored on the servers of the providers, insofar as such data is part of communications with us, or is otherwise processed by us as set out in this privacy policy. This data may, in particular, include master data and contact data of users, data on transactions, contracts, other processes and their content. The providers of the cloud services also process usage data and metadata that they use for security purposes and service optimisation.

Where we make forms or other documents and content available to other users or to publicly accessible websites with the help of cloud services, the providers may store cookies on users' devices for the purposes of web analysis or to remember users' settings (e.g. in the case of media controls).

  • Types of data processed: inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: customers; employees (e.g. staff, applicants, former employees); prospects; communication partners; users (e.g. website visitors, users of online services).
  • Purposes of processing: office and organisational procedures; information-technology infrastructure (operation and provision of information systems and technical devices (computers, servers etc.)).
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

Newsletters and electronic notifications

We send newsletters, emails and other electronic notifications (hereinafter "newsletters") only with the consent of recipients or on the basis of a statutory permission. Where the contents of a newsletter are specifically described as part of a sign-up, these descriptions are decisive for the users' consent. Otherwise, our newsletters contain information about our services and us.

To subscribe to our newsletters, it is generally sufficient to provide your email address. We may, however, ask you to provide a name for personalised address in the newsletter, or further information if this is necessary for the purposes of the newsletter.

Double-opt-in procedure: Sign-up to our newsletter takes place as a rule in a so-called double-opt-in procedure. That is, after signing up, you will receive an email asking you to confirm your sign-up. This confirmation is necessary so that no one can register with someone else's email address. Newsletter sign-ups are logged in order to evidence the sign-up process in accordance with legal requirements. This includes the storage of the time of sign-up and confirmation, as well as the IP address. Changes to your data stored at the dispatch service provider are also logged.

Deletion and restriction of processing: We may store unsubscribed email addresses for up to three years on the basis of our legitimate interests before deleting them, in order to be able to evidence a previously given consent. The processing of this data is restricted to the purpose of a possible defence against claims. An individual deletion request is possible at any time, provided that the former existence of a consent is simultaneously confirmed. In the case of obligations to permanently observe objections, we reserve the right to store the email address solely for this purpose in a block list.

The logging of the sign-up procedure is based on our legitimate interests for the purpose of evidencing its proper course. Insofar as we commission a service provider with the dispatch of emails, this is done on the basis of our legitimate interests in an efficient and secure dispatch system.

Contents:

Information about us, our services, promotions and offers.

  • Types of data processed: inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: communication partners.
  • Purposes of processing: direct marketing (e.g. by email or post).
  • Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR).
  • Right to object (opt-out): You can cancel receipt of our newsletter at any time, i.e. withdraw your consent or object to further receipt. You will find a link to cancel the newsletter either at the end of every newsletter, or you can use one of the contact options listed above — preferably email — for this purpose.

Further notes on processing operations, procedures and services:

  • Types of data processed: inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status); usage data (e.g. websites visited, interest in content, access times); event data (Facebook) ("event data" is data that may, for example, be transmitted from us to Facebook via the Facebook pixel (via apps or by other means) and relates to persons or their actions. The data includes, for example, information about visits to websites, interactions with content, functions, app installations, product purchases, etc. Event data is processed for the purpose of forming target groups for content and advertising (Custom Audiences). Event data does not include the actual content (such as comments), login information or contact information (i.e. no names, email addresses or telephone numbers). Event data is deleted by Facebook after a maximum of two years; the target groups formed from it with the deletion of our Facebook account).
  • Data subjects: communication partners.
  • Purposes of processing: direct marketing (e.g. by email or post); contact requests and communication.
  • Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

  • Measurement of open and click rates: The newsletters contain a so-called "web beacon", i.e. a pixel-sized file that is retrieved from our server, or — where we use a dispatch service provider — from its server, when the newsletter is opened. In the course of this retrieval, technical information such as information about the browser and your system, as well as your IP address and the time of retrieval, is collected.

This information is used to improve our newsletter technically on the basis of the technical data or of the target groups and their reading behaviour based on their retrieval locations (which can be determined with the help of the IP address) or access times. This analysis also includes determining whether newsletters are opened, when they are opened, and which links are clicked. This information is assigned to the individual newsletter recipients and stored in their profiles until deletion. The analyses serve to enable us to recognise the reading habits of our users and to adapt our content to them, or to send different content corresponding to the interests of our users.

The measurement of open rates and click rates, as well as the storage of measurement results in users' profiles and their further processing, take place on the basis of users' consent.

    A separate withdrawal of the success measurement is unfortunately not possible — in this case the entire newsletter subscription must be cancelled or objected to. In this case the stored profile information is deleted;

Surveys and questionnaires

We conduct surveys and questionnaires in order to gather information for the respective communicated survey or questionnaire purpose. The surveys and questionnaires we conduct (hereinafter "surveys") are evaluated anonymously. Processing of personal data only takes place to the extent that this is necessary for the provision and technical execution of the surveys (e.g. processing of the IP address in order to display the survey in the user's browser, or to enable the survey to be resumed by means of a cookie).

  • Types of data processed: contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: communication partners; participants.

Further notes on processing operations, procedures and services:

Web analytics, monitoring and optimisation

Web analytics (also referred to as "reach measurement") serves to evaluate the visitor flows of our online offering, and may include behaviour, interests or demographic information about visitors, such as age or gender, as pseudonymous values. With the help of reach analytics we can, for example, identify at which times our online offering, or its functions or content, are most frequently used or invite repeat use. Similarly, we can identify which areas require optimisation.

In addition to web analytics, we may also use testing procedures, e.g. in order to test and optimise different versions of our online offering or its components.

Unless stated otherwise below, profiles — i.e. data combined into a usage process — may be created for these purposes and information may be stored in a browser or terminal device and read out from it. The information collected includes, in particular, websites visited and the elements used there, as well as technical information such as the browser used, the computer system used, and information on usage times. Where users have consented to the collection of their location data either by us or by the providers of the services we use, location data may also be processed.

Users' IP addresses are also stored. However, we use an IP-masking procedure (i.e. pseudonymisation by truncating the IP address) to protect users. As a rule, no plain-text data of users (such as email addresses or names) is stored in the context of web analytics, A/B testing and optimisation, but pseudonyms. That is, we — as well as the providers of the software used — do not know the actual identity of users, but only the information stored in their profiles for the purposes of the respective procedures.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: reach measurement (e.g. access statistics, recognition of returning visitors); profiles with user-related information (creation of user profiles).
  • Security measures: IP masking (pseudonymisation of the IP address).

Further notes on processing operations, procedures and services:

  • Matomo (without cookies): Matomo is privacy-friendly web-analytics software, used without cookies and where the recognition of returning users takes place with the help of a so-called "digital fingerprint" that is stored anonymously and changed every 24 hours. With the "digital fingerprint", user movements within our online offering are recorded using pseudonymised IP addresses in combination with browser settings on the user side, in such a way that no conclusions can be drawn about the identity of individual users. The data of users collected via Matomo is processed only by us and is not shared with third parties; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • We work with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website. This is done through behavioural measurements, heatmaps and session recordings, in order to improve and market our products/services. The data on website usage is collected with the help of first- and third-party cookies as well as other tracking technologies, in order to determine the popularity of products/services and online activities. Additionally, we use this information for website optimisation, for security purposes and for advertising. Further information on how Microsoft collects and uses your data can be found in the Microsoft Privacy Statement: https://www.microsoft.com/privacy/privacystatement.

Online marketing

We process personal data for the purposes of online marketing, which in particular may include the marketing of advertising space or the display of advertising and other content (collectively referred to as "content") based on the potential interests of users, as well as the measurement of its effectiveness.

For these purposes, so-called user profiles are created and stored in a file (so-called "cookie"), or similar procedures are used, by means of which the information about the user relevant for the display of the aforementioned content is stored. This information may include, for example, content viewed, websites visited, online networks used, but also communication partners and technical information such as the browser used, the computer system used, and information on usage times and functions used. Where users have consented to the collection of their location data, this may also be processed.

Users' IP addresses are also stored. However, we use available IP-masking procedures (i.e. pseudonymisation by truncating the IP address) to protect users. As a rule, no plain-text data of users (such as email addresses or names) is stored in the context of online marketing procedures, but pseudonyms. That is, we — as well as the providers of the online marketing procedures — do not know the actual identity of users, but only the information stored in their profiles.

The information in the profiles is generally stored in cookies or by means of similar procedures. These cookies can later generally also be read out on other websites that use the same online marketing procedure, and analysed for the purposes of displaying content, as well as supplemented with further data and stored on the server of the online marketing procedure provider.

In exceptional cases, plain-text data may be assigned to the profiles. This is the case, for example, where users are members of a social network whose online marketing procedure we use, and the network links the users' profiles with the aforementioned data. Please note that users may make additional arrangements with the providers, e.g. by consent in the course of registration.

We generally only receive access to summarised information about the success of our advertisements. However, in the context of so-called conversion measurements we can check which of our online marketing procedures has led to a so-called conversion, i.e. for example, the conclusion of a contract with us. Conversion measurement is used solely to analyse the success of our marketing measures.

Unless otherwise stated, we ask you to assume that cookies used are stored for a period of two years.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: reach measurement (e.g. access statistics, recognition of returning visitors); tracking (e.g. interest- and behaviour-related profiling, use of cookies); marketing; profiles with user-related information (creation of user profiles); conversion measurement (measurement of the effectiveness of marketing measures); provision of our online offering and user-friendliness; remarketing.
  • Security measures: IP masking (pseudonymisation of the IP address).
  • Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • Right to object (opt-out): We refer to the privacy notices of the respective providers and to the opt-out possibilities provided by them. Where no explicit opt-out option has been indicated, there is, on the one hand, the possibility for you to switch off cookies in your browser settings. This may, however, restrict the functionality of our online offering. We therefore additionally recommend the following opt-out options, which are summarised by region:

    a) Europe: https://www.youronlinechoices.eu.
    b) Canada: https://www.youradchoices.ca/choices.
    c) USA: https://www.aboutads.info/choices.
    d) Cross-regional: https://optout.aboutads.info.

Further notes on processing operations, procedures and services:

  • Google Ad Manager: We use the "Google Marketing Platform" (and services such as "Google Ad Manager") to place ads in the Google advertising network (e.g. in search results, in videos, on websites, etc.). The Google Marketing Platform is characterised by the fact that ads are displayed in real time based on the assumed interests of users. This allows us to display ads for and within our online offering more selectively, in order to present users only with ads that potentially correspond to their interests. If, for example, a user is shown ads for products in which they were interested on other online offerings, this is referred to as "remarketing"; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Website: https://marketingplatform.google.com. Privacy policy: https://policies.google.com/privacy.
  • AdMob: platform for displaying advertising content in mobile applications; Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); standard contractual clauses: https://business.safety.google/adscontrollerterms/; Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Website: https://admob.google.com/home/. Privacy policy: https://policies.google.com/privacy.
  • Google Ads and conversion measurement: online marketing procedure for the purpose of placing content and advertisements within the service provider's advertising network (e.g. in search results, in videos, on websites, etc.) so that they are displayed to users who are presumed to be interested in the ads. In addition, we measure the conversion of the ads, i.e. whether the users have taken them as an opportunity to interact with the ads and use the advertised offers (so-called conversion). However, we only receive anonymous information and no personal information about individual users; Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Website: https://marketingplatform.google.com; Privacy policy: https://policies.google.com/privacy; Basis for third-country transfer: EU–US Data Privacy Framework (DPF).
  • Google Ads Remarketing: Google Remarketing, also known as retargeting, is a technology that allows users of an online service to be added to a pseudonymous remarketing list, so that ads can be displayed to the users on other online offerings on the basis of their visit to the online service; Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Legal bases: consent (Art. 6(1) sentence 1 lit. (a) GDPR); Website: https://marketingplatform.google.com; Privacy policy: https://policies.google.com/privacy; Basis for third-country transfer: EU–US Data Privacy Framework (DPF).

Customer reviews and rating procedures

We participate in review and rating procedures in order to evaluate, optimise and promote our services. When users review us via the participating review platforms or procedures, or otherwise provide feedback, the terms and conditions or terms of use, as well as the privacy notices of the providers, additionally apply. Reviews also usually require registration with the respective providers.

To ensure that the reviewing persons have actually used our services, we transmit, with the customer's consent, the data required for this purpose with regard to the customer and the service used to the respective review platform (including name, email address and order number or item number). This data is used solely to verify the authenticity of the user.

  • Types of data processed: contract data (e.g. subject of the contract, term, customer category); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: customers; users (e.g. website visitors, users of online services).
  • Purposes of processing: feedback (e.g. collecting feedback via online form); marketing.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

  • Rating widget: We integrate so-called "rating widgets" into our online offering. A widget is a functional and content element integrated into our online offering, displaying variable information. It may, for example, take the form of a seal or comparable element, sometimes also called a "badge". In this process, the corresponding content of the widget is displayed within our online offering, but is in that moment retrieved from the servers of the respective widget provider. This is the only way the current content can always be shown, in particular the current rating at any given time. For this purpose, a data connection must be established from the page within our online offering being accessed to the widget provider's server, and the widget provider receives certain technical data (access data, including IP address) that is necessary in order for the content of the widget to be delivered to the user's browser. Furthermore, the widget provider receives information that users have visited our online offering. This information may be stored in a cookie and used by the widget provider to recognise which online offerings that take part in the review procedure have been visited by the user. The information can be stored in a user profile and used for advertising or market research purposes; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • Google Customer Reviews: service for collecting and/or displaying customer satisfaction and customer opinions; Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Website: https://www.google.com/; Privacy policy: https://policies.google.com/privacy; Basis for third-country transfer: EU–US Data Privacy Framework (DPF).

Presences in social networks (social media)

We maintain online presences within social networks and, in this context, process the data of users in order to communicate with the users active there or to offer information about us.

We point out that users' data may thereby be processed outside the area of the European Union. This may result in risks for users, e.g. because enforcement of users' rights could be more difficult.

Furthermore, users' data within social networks is generally processed for market research and advertising purposes. For example, usage profiles can be created on the basis of users' usage behaviour and the resulting interests. The usage profiles can in turn be used, for example, to display advertisements within and outside the networks that are presumed to correspond to the users' interests. Cookies are generally stored on users' computers for these purposes, in which the users' usage behaviour and interests are stored. Furthermore, in usage profiles, data may also be stored independently of the devices used by users (in particular if users are members of the respective platforms and are logged in to them).

For a detailed description of the respective forms of processing and the opt-out possibilities, we refer to the privacy policies and statements of the operators of the respective networks.

Also in the case of access requests and the assertion of data subject rights, we point out that these can be asserted most effectively with the providers. Only the providers have access to users' data and can take appropriate measures and provide information directly. Should you nevertheless require assistance, please feel free to contact us.

  • Types of data processed: contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: contact requests and communication; feedback (e.g. collecting feedback via online form); marketing.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

Plug-ins and embedded functions and content

We integrate functional and content elements into our online offering that are obtained from the servers of their respective providers (hereinafter referred to as "third-party providers"). These may, for example, be graphics, videos or city maps (hereinafter uniformly referred to as "content").

The integration always requires that the third-party providers of this content process the IP address of users, since without the IP address they could not send the content to their browser. The IP address is therefore necessary for the display of this content or functions. We endeavour to use only such content whose respective providers use the IP address solely for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, the time of the visit, as well as further information on the use of our online offering, and may be combined with such information from other sources.

  • Types of data processed: usage data (e.g. websites visited, interest in content, access times); meta-, communication and procedural data (e.g. IP addresses, time stamps, identification numbers, consent status); inventory data (e.g. names, addresses); contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms).
  • Data subjects: users (e.g. website visitors, users of online services).
  • Purposes of processing: provision of our online offering and user-friendliness.
  • Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).

Further notes on processing operations, procedures and services:

  • Integration of third-party software, scripts or frameworks (e.g. jQuery): We integrate into our online offering software that we retrieve from the servers of other providers (e.g. function libraries that we use for the presentation or user-friendliness of our online offering). In doing so, the respective providers collect the IP address of users and may process it for the purposes of transmitting the software to the user's browser, as well as for security purposes and the evaluation and optimisation of their offering; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR).
  • YouTube videos: video content; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); right to object (opt-out): opt-out plug-in: https://tools.google.com/dlpage/gaoptout, settings for the display of advertising: https://adssettings.google.com/authenticated; Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Website: https://www.youtube.com. Privacy policy: https://policies.google.com/privacy.
  • YouTube videos (extended privacy mode): video content; YouTube videos are integrated via a special domain (recognisable by the "youtube-nocookie" component) in so-called "extended privacy mode", which means that no cookies for user activities are collected for the purpose of personalising video playback. Nevertheless, information on user interaction with the video (e.g. remembering the last playback position) may be stored; Legal bases: legitimate interests (Art. 6(1) sentence 1 lit. (f) GDPR); Service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; Website: https://www.youtube.com. Privacy policy: https://policies.google.com/privacy.

Changes and updates to the privacy policy

We ask you to inform yourself regularly about the content of our privacy policy. We adapt the privacy policy as soon as the changes to the data processing we carry out make this necessary. We will inform you as soon as the changes require a cooperative action on your part (e.g. consent) or any other individual notification.

Where we provide addresses and contact information of companies and organisations in this privacy policy, please note that these may change over time, and we ask you to verify the information before making contact.

Definitions

This section provides an overview of the terminology used in this privacy policy. Where the terminology is defined by law, the statutory definitions shall apply. The explanations below, by contrast, are intended primarily for the purposes of understanding.

  • Conversion measurement: Conversion measurement (also referred to as "visit-action evaluation") is a procedure by which the effectiveness of marketing measures can be determined. For this purpose, a cookie is generally stored on the users' devices within the websites on which the marketing measures take place, and is then retrieved again on the target website. For example, this allows us to track whether the advertisements we have placed on other websites have been successful.
  • Personal data: "Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Profiles with user-related information: The processing of "profiles with user-related information", or "profiles" for short, covers any form of automated processing of personal data which consists of using such personal data to analyse, evaluate or predict certain personal aspects relating to a natural person (depending on the type of profiling, this may include different information regarding demographics, behaviour and interests, such as interaction with websites and their content, etc.; e.g. interests in particular content or products, click behaviour on a website, or location). Cookies and web beacons are frequently used for profiling purposes.
  • Reach measurement: Reach measurement (also referred to as web analytics) serves the evaluation of the visitor flows of an online offering and may include the behaviour or interests of visitors in particular information, such as the content of websites. With the help of reach analytics, website owners can, for example, recognise at what times visitors visit their website and what content they are interested in. As a result, they can, for example, better adapt the content of the website to the needs of their visitors. For the purposes of reach analytics, pseudonymous cookies and web beacons are frequently used in order to recognise returning visitors and thus to obtain more precise analyses of the use of an online offering.
  • Remarketing: "Remarketing", or "retargeting", refers to the practice, for example for advertising purposes, of noting which products a user has been interested in on a website, so that the user can be reminded of these products on other websites, e.g. in advertisements.
  • Tracking: "Tracking" refers to the practice of being able to trace the behaviour of users across multiple online offerings. As a rule, behavioural and interest-related information regarding the online offerings used is stored in cookies or on the servers of the providers of the tracking technologies (so-called profiling). This information can then, for example, be used to display ads to users that are likely to correspond to their interests.
  • Controller: A "controller" is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Processing: "Processing" is any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and effectively covers any handling of data, whether collecting, evaluating, storing, transmitting or deleting.
